General Terms and Conditions (GTC)

Last updated: 26 September 2026

1. Scope of Application

These General Terms and Conditions apply to all orders placed by consumers and business customers through our online shop.

A consumer is any natural person who enters into a legal transaction for purposes that are predominantly outside their trade, business or independent professional activity.

A business customer is any natural or legal person or partnership with legal capacity acting in the course of their trade, business or independent professional activity when entering into a legal transaction.

2. Seller and Contracting Party

The purchase contract is concluded with:

Waidewelt is an online shop operated by MeGa HWG.

3. Conclusion of the Contract

The presentation of products in our online shop does not constitute a legally binding offer but rather a non-binding invitation to place an order.

By submitting your order through the checkout process, you make a binding offer to conclude a purchase contract for the products contained in your shopping cart.

After submitting your order, you will automatically receive an email confirming its receipt. This automatic order confirmation merely acknowledges that we have received your order and does not constitute acceptance of your offer.

A purchase contract is concluded only when we expressly accept your order by email, send a shipping confirmation or dispatch the goods to you.

We reserve the right to reject individual orders where legitimate reasons exist, for example in cases of obvious pricing errors, unavailable goods or suspected misuse of the ordering process.

4. Products and Availability

Products displayed in our shop may differ slightly from their appearance on screen in terms of colour, material appearance, engraving or presentation. Such technically unavoidable and customary variations do not constitute defects, provided they do not impair normal use.

If an ordered product is exceptionally unavailable, we will inform you without undue delay. Any payments already made will be refunded promptly.

5. Prices and Shipping Costs

All prices shown are total prices and include the applicable statutory value-added tax (VAT).

Additional shipping costs may apply. Shipping costs depend on the destination country and the order value. The applicable shipping costs are specified in our shipping information and displayed again during checkout before you submit your order.

6. Payment

The payment methods available in our shop are displayed during checkout. Payment becomes due immediately upon conclusion of the contract, unless otherwise specified for the selected payment method.

7. Delivery

Delivery will be made to the shipping address provided during checkout.

Unless a different delivery time is specified for a particular product, delivery will take place within the period stated in our shop.

Should exceptional delivery delays occur, we will inform you without undue delay.

The statutory provisions governing the risk of loss or damage during shipping apply to consumers.

8. Retention of Title

The goods remain our property until full payment has been received.

9. Right of Withdrawal

Consumers have the statutory right of withdrawal. Details concerning this right, its requirements, deadlines and consequences are set out in our Withdrawal Policy.

Where permitted by law, the right of withdrawal does not apply, particularly to goods that are not prefabricated and whose manufacture is determined by an individual choice or specification made by you, or to goods clearly tailored to your personal needs.

10. Voluntary Exchange of Non-Personalised Standard Products

Independently of the statutory right of withdrawal, we voluntarily offer consumers the opportunity to exchange unused, complete and non-personalised standard products for another available product variant within 14 days of receiving the goods. There is no legal entitlement to such an exchange.

To request a voluntary exchange, you must contact us in advance at info@waidewelt.com. Goods may only be returned after prior agreement with us.

If an exchange is requested due to an incorrect product selection, the customer bears the costs of returning the original product and shipping the replacement. We charge a flat exchange fee of €6.50 for providing a return shipping label, including shipping the replacement product. If the customer returns the goods at their own expense, we charge €3.90 for shipping the replacement product.

Any price differences between the originally ordered product and the requested replacement product will be charged or refunded accordingly.

The replacement product will be dispatched after the returned goods have been received and inspected and after any applicable price differences and shipping charges have been paid in full.

Personalised products, custom-made items and products manufactured according to customer specifications are excluded from voluntary exchanges.

The statutory right of withdrawal and statutory rights relating to defective goods remain unaffected by this voluntary exchange policy. If the delivered goods are defective or a product other than the one ordered has been delivered, the statutory rights relating to defective goods apply, and no exchange fee will be charged.

11. Personalised and Individually Manufactured Products

For personalised, engraved or otherwise individually manufactured products made according to customer requirements, you are responsible for carefully checking all information you provide before completing your order.

We accept no liability for errors resulting from data, texts, designs or other specifications provided by you, unless the error is attributable to our own fault.

We reserve the right to reject personalised orders if the submitted content violates applicable law or the rights of third parties.

Personalised products and products individually manufactured according to customer specifications are excluded from voluntary exchanges. Where the statutory conditions are met, these products are also excluded from the right of withdrawal. Statutory rights relating to defective goods remain unaffected.

12. Statutory Warranty Rights

The statutory rights relating to defective goods apply.

For business customers, the following applies: The limitation period for claims relating to defects in newly manufactured goods is one year from delivery of the goods. The statutory limitation periods for rights of recourse and claims arising from intentional or grossly negligent breaches of duty, injury to life, body or health, and claims under the German Product Liability Act remain unaffected.

13. Liability

We are liable without limitation for damages arising from injury to life, body or health, damages caused by intentional or grossly negligent breaches of duty, and under the German Product Liability Act.

In cases of slightly negligent breaches of essential contractual obligations, our liability is limited to foreseeable damages typical of the contract. Essential contractual obligations are those whose fulfilment is necessary for the proper performance of the contract and upon whose observance you may regularly rely.

In all other respects, liability for damages caused by slight negligence is excluded.

The above limitations of liability also apply for the benefit of our legal representatives, employees and agents engaged to fulfil our contractual obligations.

14. Content, Usage Rights and Intellectual Property

All content published in our shop, particularly texts, images, graphics, designs, logos and product illustrations, is protected by copyright or other intellectual property rights.

Use of this content is permitted only within the scope of the intended use of our shop. Any further use, particularly reproduction, modification, distribution or public communication, requires our prior express consent unless permitted by law.

15. Permitted Use of the Shop

You may use our shop only for lawful purposes. In particular, any use that adversely affects our shop, our systems or other users, or that violates applicable law, is prohibited.

The use of automated systems for large-scale data extraction is prohibited unless we have expressly authorised such use.

16. Links to Third-Party Websites and External Services

Our shop may contain links to external websites or services operated by third parties. We accept no responsibility for the content, availability or data protection practices of these third parties to the extent that these matters are beyond our control.

17. Contract Language and Storage of Contractual Documents

The language available for the conclusion of the contract is German.

We store the contractual documents in accordance with our legal obligations. Your order details and the applicable contractual terms will be sent to you by email after placing your order or may be accessed through your customer account, if such an account is offered.

18. Applicable Law

The laws of the Federal Republic of Germany apply, excluding the United Nations Convention on Contracts for the International Sale of Goods (CISG).

If you are a consumer habitually resident in another member state of the European Union, the mandatory consumer protection provisions of that state remain unaffected.

19. Dispute Resolution

We are neither obliged nor willing to participate in dispute resolution proceedings before a consumer arbitration body.

20. Severability

If any provision of these General Terms and Conditions is or becomes wholly or partially invalid, the validity of the remaining provisions shall remain unaffected.
